Healing Arts Terms

Scope of services

Vanessa Del Castillo Merino, operating as The Light Arts, offers energy healing, facilitation, womb-centered and earth-based practices for personal and spiritual wellbeing. These services are complementary in nature and are not a substitute for medical, psychological, legal, or other professional care.

Client responsibility

Clients are responsible for providing accurate and complete information regarding their physical, emotional, and mental health. The Light Arts accepts no responsibility for outcomes where information is misstated or withheld.

Medical disclaimer

The information, techniques, and practices offered are not intended to diagnose, treat, cure, or prevent any disease. If you are under medical care for any condition, do not adjust or discontinue prescribed medication without consulting your qualified healthcare provider. If in doubt, seek medical advice.

Limitation of liability

To the fullest extent permitted by law, Vanessa Del Castillo and The Light Arts shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from the use of, or inability to use, any services, information, or techniques provided, now or in the future.

Consent

By participating in any session, workshop, circle, or ceremony, you acknowledge that you do so voluntarily and take full responsibility for your own wellbeing, choices, and actions.

Jurisdiction

The Light Arts operates internationally. These Terms are governed by the laws of the jurisdiction in which The Light Arts is principally based at the time services are delivered.

Payments, Rescheduling & Cancellation Policy

  • All sessions must be paid in full at the time of booking via our online platform or direct bank transfer. Cash, cheques, or other payment methods are not accepted.

  • Cancellations or rescheduling require a minimum of 24 hours notice.

  • Changes made within 24 hours of your session will incur a 50% rescheduling fee.

  • Cancellations or rescheduling within 12 hours of the session will be charged at the full session price.

  • Please note: This policy applies regardless of reasons such as travel changes, work emergencies, childcare issues, or illness.

Design & Branding Terms

Scope of Services

Vanessa Del Castillo, operating as The Light Arts Design, offers brand strategy, logo design, visual identity design, web design, art direction, and related creative consulting services for businesses and personal brands.

All services are delivered according to the scope, deliverables, timeline, and fees outlined in the relevant proposal, quote, invoice, or client agreement. Any additional work requested outside the agreed scope will be billed at an hourly rate, or quoted separately, and will not begin until approved by the client.

Client Responsibility

Clients are responsible for providing clear, accurate, and timely information, feedback, content, imagery, and any other materials required for the project. Delays in providing these may impact the project timeline.

Clients are also responsible for reviewing all work carefully before approval, including text, spelling, dates, contact details, pricing, links, and any other content. The Light Arts Design is not responsible for errors that are approved by the client and later discovered after sign-off or launch.

Revisions and Additional Work

Each service includes the number of revisions specified in the relevant proposal or agreement. Revisions beyond the included amount, or requests that fall outside the agreed project scope, will be charged at an hourly rate.

Additional work may include, but is not limited to:

  • extra design concepts

  • new pages or sections

  • copywriting or copy changes beyond the agreed scope

  • additional rounds of revisions

  • additional graphics or visuals not provided by the client

  • new collateral or assets not included in the original package

  • technical troubleshooting or support beyond the agreed deliverables

Invoicing and payment terms

A deposit is required to secure your booking and commence work. Final files, website launch, or transfer of deliverables will only be provided once full payment has been received, unless otherwise agreed in writing.

All payments are non-refundable once work has commenced, due to the time, strategy, and creative development already invested in the project.

Invoices will be sent via email.

Payments are due within 7 days of the invoice date. Late payments may incur a 1.5% monthly fee on the outstanding balance.

Currency and billing

If you are based in Australia, you will be billed in Australian Dollars (AUD). If you are based outside of Australia, you will be billed in United States Dollars (USD). This will be determine based on where you are located when we send your invoice.

Timelines

Project timelines are estimates and may vary depending on the client’s responsiveness, project complexity, and any changes to the original scope. The Light Arts Design is not responsible for delays caused by the client, third-party providers, or unforeseen circumstances.

If a project is paused or inactive for an extended period due to lack of communication or missing content from the client, The Light Arts Design reserves the right to reschedule the project or apply a restart fee.

Third-party services

Projects may involve third-party platforms or services such as website hosting providers, domain registrars, email marketing platforms, booking systems, payment processors, plugins, fonts, or stock imagery providers. The Light Arts Design is not responsible for the performance, outages, price changes, terms, or policies of any third-party service.

Any third-party fees are the responsibility of the client unless otherwise agreed.

Intellectual property

All concepts, drafts, and creative work remain the intellectual property of The Light Arts Design until full payment has been received.

Upon full payment, the client receives the agreed final deliverables for approved business use. The Light Arts Design retains the right to display completed work in its portfolio, website, and promotional materials unless otherwise agreed in writing.

The client is responsible for ensuring they have the appropriate rights to use any content, imagery, fonts, logos, or other materials they provide for the project.

Website services disclaimer

While The Light Arts Design aims to create functional and professional websites, no guarantee is made regarding specific business results, sales, search engine rankings, client enquiries, or technical performance outside the delivered design scope.

Once a website is launched or handed over, ongoing updates, maintenance, software changes, platform issues, or third-party integrations may affect performance over time unless ongoing support has been agreed separately.

Limitation of liability

To the fullest extent permitted by law, Vanessa Del Castillo and The Light Arts Design shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from the use of, or inability to use, any services, deliverables, or website elements provided.

The client agrees that they use all deliverables and recommendations at their own discretion and responsibility.

Acceptance

By engaging The Light Arts Design, paying an invoice, or signing a proposal or agreement, the client acknowledges that they have read, understood, and accepted these Terms & Conditions.

Jurisdiction

The Light Arts Design operates internationally. These Terms & Conditions are governed by the laws of the jurisdiction in which The Light Arts Design is principally based at the time services are delivered.
